Terms and Conditions
All rentals are subject to the following Terms and Conditions:
1. Booking
Signing of the booking form by the 'Principle Hirer' confirms acceptance of the 'Terms and Conditions' set out below and shall be binding upon the persons listed on the booking form.
2. Deposits and Payments
All correspondence will be sent to the person named as the 'Principle Hirer' at the address specified on the booking form.
The 'Principle Hirer' must enclose a deposit of £200/$300 with the completed booking form.
The Balance plus a £200/$300 Security Deposit must be paid at least eight weeks before your departure date.
The booking is not accepted until the 'Principle Hirer' receives an acknowledgement letter.
We reserve the right to refuse bookings as we see fit.
Any monies paid will be refunded if a booking is not accepted.
3. Period of Rental
The rental period commences from 4pm on the day of arrival and the villa must be vacated by 10am on the day of departure. (Requests can be made to change these times provided there are no back to back bookings.)
4. Refundable Security Deposit Your Security Deposit will be returned to you as soon as possible after you return to the UK and, after we have received confirmation from our Management Company that the villa has been left in a satisfactory condition.
5. Liability
Although every effort will be made to ensure that the villa is in perfect order for your holiday, we are unable to accept liability for any third party claim, accident, damage or loss to you or your property or any expenses incurred for any reason.
You are advised to obtain your own holiday and Medical Insurance.
The owner, their agents or representatives will not be liable for:
Any loss or delay caused by force majeure (e.g. strikes, floods, conditions over which they have no control)
Any loss due to noise or disturbance from anywhere within the vicinity of the rental property.
Any loss due to complaints arising from construction. The 'Principle Hirer' is hereby made aware that, as on many estates, there will be other homes under constructions.
Any personal injury, death, accident or loss or damage to persons or personal effects however caused.
6. Your Responsibilities
The owners and management company wish to ensure that guests fully enjoy and appreciate the advantages that the use of a private villa will provide to families on holiday, therefore to make sure the villa is presented in an acceptable condition for their occupancy, important terms and conditions have to be placed on each occupant.
The property, furniture, fittings and other facilities must be treated with respect. Any loss, damage or breakage, must be reported to the Management Company immediately, (contact details can be found in the guest's file in the villa). The guest may be able to replace, or make good, any loss/breakage/damage to the satisfaction of the management company. If this is not possible, the owner or management company reserve the right to withhold monies from the security deposit to replace or make good any loss/breakage/damage caused by any member of the party.
The 'Principle Hirer' will be held responsible for ensuring that the alarm system is set and all doors and windows are secured whenever the villa is vacated for any period of time. The villa is a non smoking villa and the 'Principle Hirer' will be responsible for ensuring that members of the party adhere to this policy. Smoking is allowed in the pool area and ash trays are provided for this purpose.
The 'Principle Hirer' will be responsible for ensuring that only those persons named on the Booking Form shall reside at the Accommodation . The owners reserve the right to withhold the full Security Deposit, if the 'Principle Hirer' fails to observe this responsibility.
The 'Principle Hirer' will be held responsible for refunding the full cost of any damage to the villa and any items stolen or missing during their stay, if he or she fails to set the alarm whenever the villa is vacated for any period.
7. Free International and Local Telephone calls
Villa ‘Sundown’ offers free Local and International calls to Landlines only during your stay. This facility does not include calls to mobile numbers outside the USA or calls assisted by the Operator. Calls of this type incur a charge of approximately $3.50 per minute instead of a charge of 10 cents per minute.
Please use the correct Country Code and do not make calls to mobile numbers outside the USA. If the Operator intercepts your call it probably means that you have dialled the wrong Country Code. Do not accept an offer from the Operator to connect you to a country outside the USA. Politely decline and establish the correct Country Code, from the Telephone Books provided in the Villa, before dialling again.
Guests using the Operator to connect their call to a country outside the USA, or making calls to mobiles outside the USA, will be charged the appropriate cost and this will be deducted from their Security Deposit.
8. Safety
Children must be supervised by an adult whilst they are in the pool area. A pool alarm is installed in the villa to alert adults whenever a door to the pool is opened. In accordance with US laws it is illegal to deactivate this alarm. Glass must not be taken on to the pool deck or in the pool, plastic glasses are provided for this purpose.
9. Cleaning
The property will be cleaned prior to your arrival and after you have departed. Should you require the option of a weekly clean (to include all linen and towels); a request must be made prior to the commencement of your holiday along with the appropriate fee which will be advised.
Although the property will be cleaned after your departure, the 'Principle Hirer' is responsible for ensuring when the villa is vacated it is left in an orderly state with all dirty kitchen utensils placed in the dishwasher. Should the property require extensive cleaning, the owners reserve the right to withold monies from the security deposit to cover the extra cleaning charges.
10. Climate
The 'Principle Hirer' is hereby made aware that as Florida enjoys a tropical climate it is the home of many insects. The villa is treated regularly to repel such unwanted visitors but inevitably insects will occasionally find their way into the property from time to time. They are best eradicated by spraying with an appropriate product.
11. Pool Heating
Pool heating is available as an optional extra and can be ordered at the time of booking. Pool heating is recommended during the period October through to March. However, if you wish to use the Jacuzzi you will require pool heating.
12. Guests
The owners will not accept bookings from young male or female parties or groups of people under the age of 21 without prior discussion and agreement.
13. Complaints
Complaints relating to the accommodation must be made verbally to the management company followed in writing within 24 hours of any complaint arising. The management company will endeavour to rectify any problem. The owners, their agents or representatives will not be liable for any complaint that was not initially registered with the management company.
14. Maintenance
Regular maintenance will take place on the property from time to time and this includes pool/filter cleaning, lawn cutting and pest control. The list of maintenance items will include anything that is required and contractors will endeavour to provide these services when the villa is unoccupied, however in the event that this is not possible they will keep disruption to a minimum.
15. Cancellation
In the event that you should cancel your booking for whatever reason, the following cancellation charges will apply:
From time of booking - All Deposits
Between 6 and 10 weeks - 50% of the Rental Charge
Less than 6 weeks - 100% of the Rental Charge
16. Insurance The 'Principle Hirer' is strongly recommended to advise his/her party to take out adequate holiday insurance to cover cancellation, accidents/illness or damage. If you are renting a vehicle be advised that it is unlikely that your holiday insurance will cover you for liability whilst driving a motorised vehicle. It is therefore advisable to take out the extra cover offered by your car rental company.
17. Passports
It is your responsibility to ensure that you and members of your party are in possession of in date passports and any appropriate visas. British Passports must be valid for three months from the date of your DEPARTURE from the USA
18. Disclaimer
18.1 Ourselves or any representative of us shall not be liable to the Client for the death of or injury to the Client or loss or damage to the Client's property unless due to negligence and/or failure of ourselves to perform our obligations under this agreement or under the general law
18.2 For the avoidance of doubt, none of the payments include the cost of appropriate travel/holiday insurance, and the Client is advised to take out appropriate cover.
18.3 In particular, we wish to draw to the attention of the Client that where the accommodation includes a swimming pool, care must be taken and children supervised at all times.
18.4 The Client's Accommodation may be situated on a development which consist of both residential and vacation homes. We shall not be liable to the Client for any noise, nuisance or inconvenience suffered as a result of any ongoing construction or repair work being carried out |
